 Why use Debtbrief’s forms?

Debt collectors are tricky, and they plan to obtain a judgment against you by filing a lawsuit and hoping you don’t respond. When you don’t respond, the court enters a judgment against you for the amount you owe, and usually adds interest, attorney fees, service charges, etc. A $1,000 debt can quickly turn into a $3,000 judgment. Then the creditor can use that judgment to garnish wages and bank accounts. Debtbrief’s forms will help you push back.

 How do the forms help?

The first key to stopping a debt collector is responding to anything they file in court. If you respond in the right way, the judge will usually make the creditor prove that you owe the debt, rather than grant a default judgment without reviewing the case. Our forms will help you respond to the documents creditors usually file. And our forms come with an extensive instruction outline that teaches you how to use the forms most effectively.

Should I use the forms if I admit I owe the debt?

Yes! By simply responding you can have the opportunity to tell the judge that although you agree you owe the debt, you may not owe the interest, attorney fees or service charges. This could save you hundreds or thousands of dollars. And don’t forget that even if you know you owe, it’s the creditor’s responsibility to prove that you owe the debt. If they file the lawsuit but don’t have the necessary proof, you could win your case just by responding, and owe them nothing.

How should I use these forms?

Just follow the instructions. Once you complete your purchase, you’ll reach a page where you can download all the forms. You should also receive an email with a link to download the forms if you need them later. And you can always log back in to the website to download the forms again. Once you download the forms you can either print them and fill them out by hand, or fill them out on a computer. The forms all come in .doc format so you can use them in any word processor. Once you fill out a form you can file it with the court. If you start filing responses to the creditor’s filings, they’ll know you plan to defend your case. One option from there is to contact them to discuss the case, then try to negotiate a settlement.

 Do I need an attorney?

Having an attorney will be better than not having an attorney, but you don’t need one to use Debtbrief’s forms. You can handle your case on your own. However, consulting an attorney is advised to ensure you are using the forms correctly. You should contact your state’s local bar association and see if they have any free legal resources. A free attorney may be more willing to assist with your case if they only need to review your forms, rather than review the entire case and create the forms for you.

What if I need more help but can’t afford a lawyer?

We can help you with that to. We provide 1:1 coaching to people in debt collection lawsuits. In order to keep your costs low, you can meet with an attorney who can teach you how to defend your debt collection lawsuit on your own, without a lawyer representing you. You won’t receive specific legal advice on your case, but you will learn exactly what lawyers know about defending these cases. In other words, your coaching session will be just like going to law school. By the end of your coaching session, you will feel comfortable knowing exactly what you need to do to defend your debt collection lawsuit without a lawyer. And better yet, if you sign up for a coaching session, we will include our set of legal forms at no additional charge. If you are interested in signing up, click HERE.
